Original Tender Description

The London Housing Consortium (LHC) (acting as the Central Purchasing Body for the South West Procurement Alliance (SWPA)), are consulting on the potential establishment of a DPS Agreement for Construction of residential dwellings (including any associated community buildings and facilities) incorporating low energy offsite system across the South West. The DPS is aimed at delivering offsite / MMC housing, apartments, care homes and multi-occupancy dwellings including zero carbon solutions. This DPS application process will run in conjunction with a new digital toolkit from Constructing Modern Methods (CMM). CMM was developed as a concept in a previous piece of research funded by the Local Government Association and conducted with Bristol City Council (BCC) and Bristol Housing Festival (BHF) to understand what resources might make the widescale adoption of modern methods of construction and offsite housing solutions more feasible. Candidates will need to register as a supplier on SWPA's eTendering portal, ProContract before being able to apply to the DPS. Once registered candidates will need to ensure they are logged in and click the appropriate DPS link from the opportunity list by filtering 'organisations' and selecting LHC. Once they have entered the Low Carbon Offsite Construction DPS the candidate should click on 'register interest in this opportunity'

Tender Quality Score

This tender for a Dynamic Purchasing System (DPS) demonstrates a strong commitment to sustainability and innovation but suffers from significant deficiencies in clarity, completeness, and fairness due to missing critical documentation details.

Score Breakdown

Legal Compliance75/100

The tender generally adheres to a DPS framework, but the explicit lack of detailed mandatory exclusion grounds, as highlighted by the AI-extracted requirements, represents a notable legal compliance gap. CPV codes are appropriate, and no disputes are flagged.

No explicit details on mandatory exclusion grounds provided.
Clarity40/100

While the overall purpose and scope of the DPS (low carbon offsite MMC housing) are clearly described, the tender severely lacks clarity regarding specific supplier requirements and, critically, the evaluation criteria for admission to the DPS. This makes it difficult for potential suppliers to understand the application process.

Missing specific supplier requirements.
No evaluation criteria specified for DPS admission.
Completeness50/100

Basic information such as title, organization, value, and duration is complete. However, the absence of detailed mandatory exclusion grounds and evaluation criteria, along with a single, brief document summary, indicates a significant lack of comprehensive documentation for a tender of this scale.

Missing detailed mandatory exclusion grounds.
Missing evaluation criteria for DPS admission.
Fairness45/100

The use of a DPS and e-procurement generally promotes fairness. However, the critical absence of specified evaluation criteria for joining the DPS severely undermines transparency and objectivity, making it challenging for suppliers to understand how their applications will be assessed.

No evaluation criteria specified, impacting transparency and objectivity.
Practicality75/100

Electronic submission is supported via the ProContract portal, and key dates (contract start, duration, submission deadline) are clearly specified. The lack of a direct document URL is a minor inconvenience, but access via the portal is outlined.

No direct document URL provided, requiring portal registration for access.
Data Consistency85/100

Most key fields are populated, and dates are logical for an active DPS. There is a minor inconsistency in labeling the procedure as 'Restricted' while explicitly describing it as a 'DPS Agreement', though a DPS is a type of restricted procedure. The 'Liable Person' field is empty.

Minor inconsistency in procedure type labeling (Restricted vs. DPS).
Liable Person field is empty.
Sustainability80/100

The tender demonstrates a strong focus on sustainability, explicitly targeting 'Low Carbon Offsite MMC Housing Construction' and 'zero carbon solutions'. It also highlights an 'Innovation Focus' with the mention of a digital toolkit. However, no explicit social aspects are mentioned.

No explicit social aspects mentioned in the tender description.

Strengths

Strong focus on sustainability (low carbon, zero carbon solutions).
Emphasis on innovation (Modern Methods of Construction, digital toolkit).
High estimated value, indicating significant market opportunity.
Utilizes e-procurement for accessible application.
Long duration of DPS allows continuous supplier application.

Concerns

Missing explicit details on mandatory exclusion grounds.
Absence of specified evaluation criteria for joining the DPS.
Lack of comprehensive supplier requirements.
Potential inconsistency in procedure type labeling.
Limited documentation detail provided in the summary.

Recommendations

1. Publish comprehensive tender documents detailing all mandatory exclusion grounds and specific selection criteria for admission to the DPS.
2. Clearly define and publish all requirements suppliers must meet to join the DPS, ensuring transparency and fairness.
3. Clarify the procedural classification (e.g., explicitly state it's a DPS under relevant regulations) to avoid ambiguity.
