Oryginalny Opis Przetargu

Lancashire County Council (the Authority) wishes to establish an open Provider List of Break Time and Short Breaks Providers who are suitable, capable and experienced to deliver the required services. This will greatly improve choice and the ability to meet the needs of children and young people with appropriate services. Short Breaks Services ("the Services") are essential for children with disabilities, their parents and their carers, to ensure better outcomes and to prevent escalation of their needs, where possible. The term 'short breaks' describes services that help adult parent/carers to more effectively provide care for their disabled child by providing them regular breaks. The Services commissioned from the Provider List are listed below and will support the Authority in fulfilling its statutory duty to provide a full range of Short Break Services to children/young people with Special Educational Needs and Disabilities ("SEND") which is sufficient to assist their primary carers to continue to provide care or to do so more effectively. The Lots have been developed to cover the range of Services available and have been grouped to align to the service area types and Service User's needs. Applicants are invited to apply for all or any of the following Lots and there is no restrictions for the number of lots they can successful in: Lot 1a Break Time, Lot 1b Break Time Plus, Lot 2a Day Time Short Breaks, Lot 2b Day Time Personal Care, Lot 3 Night Time Overnight Short Breaks, Lot 4 Intensive Positive Behaviour Support. It is intended that the Provider List will remain effect for 5 years, with option to extend on one or more occasions, save that the length of this Provider List Agreement shall not exceed a maximum of 7 years. Service Contracts can be awarded as call-off contracts as detailed within the ITP. This procurement procedure is considered to be subject to the Light Touch Regime under the Public Contracts Regulations 2015. The Provider List is an open list: Applicants can apply to join during its term if the Applicant satisfies the selection, quality and price requirements and is able to deliver the Service as described in the Service Specifications. Evaluations of new Applications will take place annually as detailed in the ITP. The Authority reserves the right to evaluate sooner. Exact Application Evaluation deadlines dates will be communicated via the Sourcing portal as an online discussion or any other format which the Authority stipulates. It is the Authority's intention to evaluate new Applications annually or once 10 new Applications are received, whichever occurs sooner. All instructions on how to participate and apply to join the Flexible Agreement, evaluation criteria, terms and conditions and documents to be returned can be found on following webpage: https://www.lancashire.gov.uk/business/tenders-and-procurement/tenders/provider-list-for-break-time-home-care-and-short-breaks-services-for-children-and-young-people-with-disabilities/. All aspects (documents/attachments/responses) of the application can and must be submitted via the iSupplier portal. The Authority will not accept email or hard copy/paper applications in relation to this process and you must submit your application electronically via the iSupplier portal.

Ocena Jakości Przetargu

This tender aims to establish an open Provider List for essential short break services for children with disabilities, utilizing a multi-lot structure. However, the complete absence of tender documents severely hinders a comprehensive assessment of its quality and detailed requirements, rendering it effectively unbiddable.

Szczegółowy Wynik

Zgodność z przepisami100/100

The tender states it operates under the Light Touch Regime of the Public Contracts Regulations 2015, which is appropriate for health and social work services. However, the lack of explicit mandatory exclusion grounds in the provided text and the absence of full tender documents make it impossible to verify full compliance with all legal requirements.

Absence of full tender documents prevents verification of legal compliance.
Mandatory exclusion grounds not explicitly detailed in the provided text.
Przejrzystość40/100

The description provides a clear overview of the service's purpose and the lot structure. However, without the full tender documents (e.g., Invitation to Tender, specifications), the detailed requirements, evaluation criteria, and contractual terms remain entirely unclear.

Detailed service specifications are missing.
Evaluation criteria are not provided.
Kompletność83/100

The provided information is highly incomplete due to the complete absence of any attached tender documents. Key elements such as detailed requirements, evaluation criteria, submission instructions, and contract terms are missing, making it impossible for potential bidders to prepare a compliant offer.

No tender documents are attached or available.
Evaluation criteria are entirely missing.
Uczciwość80/100

The multi-lot structure and the 'open list' approach suggest an intention to promote broad participation and choice. However, the complete lack of detailed requirements and evaluation criteria makes it impossible to assess whether the process is truly fair and transparent for all potential providers. Without these, there's a significant risk of arbitrary decision-making.

Absence of evaluation criteria prevents assessment of fairness in selection.
Lack of detailed requirements could lead to subjective interpretation.
Praktyczność40/100

The concept of an open provider list for a 5-7 year duration is practical for ensuring continuous service availability and flexibility. However, the current state of the tender, with no documents, makes it entirely impractical for any supplier to understand what is required to apply or how services will be delivered.

Impossible for suppliers to prepare a bid without tender documents.
No information on the application process or required submission format.
Spójność danych100/100

The basic information provided (title, reference, organization, value, duration, lots) appears consistent within the limited scope. However, the absence of any detailed documents means there is no further content to cross-reference for consistency.

Limited data available for comprehensive consistency check.
Zrównoważony rozwój0/100

The provided information does not include any specific sustainability, green procurement, or innovation criteria. While the service itself addresses social needs, the tender documentation does not indicate an explicit focus on broader sustainability aspects.

No explicit green procurement criteria mentioned.
No specific social criteria beyond the core service provision.

Mocne strony

Clear purpose and scope (short breaks for children with disabilities).
Multi-lot structure allows for specialized providers and increased choice.
Open Provider List approach promotes continuous market engagement.
Significant estimated value indicates a substantial commitment to services.
Long contract duration (5-7 years) offers stability for providers.

Wątpliwości

**Critical:** Complete absence of tender documents, making the tender unassessable and unbiddable.
Missing detailed requirements and specifications for each lot.
Absence of evaluation criteria, leading to a lack of transparency in selection.
No information on the application process or required submission format.
Lack of explicit mandatory exclusion grounds in the provided text.

Rekomendacje

1. Immediately publish all essential tender documents, including the Invitation to Tender, detailed service specifications for each lot, and terms and conditions.
2. Clearly define and publish the evaluation criteria and the process for awarding call-off contracts from the Provider List.
3. Ensure all mandatory exclusion and selection criteria are explicitly stated and easily accessible within the tender documentation.
