Original Tender Description

The DPS comprises two lots: Lot 1: traditional bus services with set routes and timetables. Lot 2 : covers demand responsive transport and other non-typical bus provision. Note: The DPS excludes the provision of home to school transport for pupils with special transport requirements, e.g. wheelchair and/or passenger assistant. The Council has a duty under the 1985 Transport Act ‘to secure the provision of such public passenger transport services as the council consider it appropriate to secure to meet any public transport requirements … which would not in its view be met apart from any action taken by it for that purpose.’ The agreement will provide the structure to procure routes, the Bus Strategy developed during 2020 defines what the Council deems appropriate under the Act, and the call offs under this framework will procure those routes, ensuring by the appropriate qualitative criteria that any route details put forward by operators fulfil the requirements defined in the Strategy. As of June 2022 the Council provides 9 subsidised public bus services operating Mon-Sat with three of these services also operating late into the evening and on Sundays. The Council also contributes to a route procured by the Royal Borough of Windsor and Maidenhead.

Tender Quality Score

This tender for a Dynamic Purchasing System for road-based passenger transport services provides a clear description of the scope and lots, but suffers from significant gaps in explicitly detailing mandatory exclusion, eligibility, financial requirements, and evaluation criteria within the provided information. While full documents are referenced, the current summary lacks crucial details for comprehensive bidder understanding and full legal compliance.

Score Breakdown

Legal Compliance60/100

The tender defines the procedure as a Dynamic Purchasing System, which is appropriate for the long duration. However, the provided information explicitly states a lack of detail regarding mandatory exclusion grounds, eligibility requirements, and financial requirements, which are fundamental for legal compliance. The missing 'reveal date' is a minor issue for a DPS.

Missing explicit mandatory exclusion grounds in the provided information.
Missing explicit eligibility requirements in the provided information.
Clarity70/100

The description of the service, its division into lots, and exclusions is clear. However, the overall clarity is significantly hampered by the absence of specified evaluation criteria and the explicit lack of detail for mandatory exclusion, eligibility, and financial requirements. Reliance on an external '2020 Bus Strategy' without further elaboration also reduces immediate clarity.

No evaluation criteria specified.
Absence of explicit mandatory exclusion, eligibility, and financial requirements.
Completeness65/100

Basic information such as title, reference, organization, value, and duration is well-provided. However, the tender is incomplete in critical areas, specifically the explicit detailing of mandatory exclusion grounds, eligibility requirements, financial requirements, and evaluation criteria. While full documents are mentioned as available online, the provided content itself is not comprehensive.

Missing explicit mandatory exclusion grounds, eligibility requirements, and financial requirements.
No evaluation criteria specified.
Fairness75/100

The tender discloses the estimated value and implies full document access, and the long deadline for a DPS is very reasonable. However, the absence of specified evaluation criteria significantly impacts fairness, as bidders cannot objectively understand how their proposals will be assessed. There is no indication of requirements being tailored to a specific company.

No evaluation criteria specified, reducing transparency and objectivity for bidders.
Practicality60/100

The tender states 'E-Procurement' as a characteristic, which is positive, but an automated check flags 'No e-submission,' creating a contradiction. A direct URL for the full procurement documents is not provided in the snippet, which is a minor practical inconvenience. No explicit contract start date is given, though duration is clear.

Contradiction between 'E-Procurement' characteristic and 'No e-submission' automated check.
No direct document URL provided in the snippet.
Data Consistency80/100

Most key fields are populated, and dates are logical for a DPS. However, the 'Liable Person' field is empty, and there is a notable contradiction between the 'E-Procurement' characteristic and the 'No e-submission' flag from automated checks.

Contradiction between 'E-Procurement' characteristic and 'No e-submission' automated check.
'Liable Person' field is empty.
Sustainability50/100

The tender does not explicitly mention any green procurement initiatives, social aspects, or an innovation focus. It is also noted as not being EU funded, which often correlates with higher sustainability standards.

No explicit mention of green procurement criteria.
No explicit mention of social aspects.

Strengths

Clear description of the service scope and lots.
Estimated value and contract duration are clearly specified.
Procedure type (Dynamic Purchasing System) is appropriate for the long duration.
E-Procurement is indicated as a characteristic.
Value is disclosed and not classified.

Concerns

Lack of explicit mandatory exclusion grounds, eligibility, and financial requirements in the provided information.
Absence of specified evaluation criteria.
Reliance on an external '2020 Bus Strategy' without further detail.
Contradiction regarding e-submission functionality.
No explicit mention of sustainability (green, social, innovation) aspects.

Recommendations

1. Ensure all mandatory exclusion grounds, eligibility, and financial requirements are clearly detailed in the full procurement documents and, ideally, summarized in the initial notice.
2. Clearly define and publish the evaluation criteria to enhance transparency and fairness for bidders.
3. Provide a direct URL to the full procurement documents for ease of access and clarify the e-submission functionality.
