Original Tender Description

Efficiency East Midlands (EEM Ltd) is a procurement consortium which establishes and manages a range of Frameworks and DPS agreements. Our members include organisations providing services to the whole public sector including Housing Associations, Local Authorities, NHS Trusts, Education Providers and Emergency Services. For more information on EEM and our offering please visit: https://eem.org.uk/ In September 2021 EEM launched a DPS for Property Maintenance Works for contracts with a value of under £150,000. Due to current market conditions, EEM wishes to increase the value of contracts by awarding two additional categories to increase the contract value to £1,500,000. This notice covers the creation of the two new categories. EEM is conducting this tender exercise to establish a dynamic purchasing system (DPS) consisting of contractors who can undertake wide scope of property maintenance works including internal, external, and whole house improvement and maintenance works. The DPS has been set up to complement our existing Property Improvement Works Framework (EEM0056) to enable greater competition and choice to members. The DPS supports members looking to source suitable contractors to carry out property improvement and maintenance works including internal, external, and whole house improvement and maintenance works to a single or multiple occupied and void properties. The DPS initial application period will run until 23rd January 2023 and EEM will then review all applications received during the initial application period from 24th January 2023. Organisations appointed on to the DPS will receive a DPS Agreement to sign and return. The additional categories for the DPS being advertised through this opportunity will commence on 6th February 2023 ending on 26th September 2026 to fall in line with the existing DPS. Applicants can submit an application to join the DPS at any point during the DPS term and will have the option to apply for the three existing value categories.

Tender Quality Score

This tender outlines the expansion of an existing Dynamic Purchasing System (DPS) for property maintenance works, offering continuous application and clear scope. However, it lacks critical details regarding mandatory exclusion grounds, financial requirements, and evaluation criteria, impacting transparency and completeness.

Score Breakdown

Legal Compliance75/100

The tender establishes a Dynamic Purchasing System, which is a legally recognized and flexible procurement procedure. The CPV code is appropriate, and there are no reported disputes. The continuous application nature of a DPS inherently provides reasonable timeframes for suppliers.

Missing initial reveal date
Clarity60/100

The description of the DPS and the scope of works is clear and understandable. However, the explicit absence of mandatory exclusion grounds, financial requirements, and, crucially, evaluation criteria significantly diminishes the overall clarity of the application process.

No mandatory exclusion grounds explicitly stated
No financial requirements explicitly stated
Completeness65/100

Basic tender information such as title, organization, reference, value, and duration is provided. Nevertheless, the tender is incomplete regarding essential details like mandatory exclusion grounds, financial requirements, and how applications will be evaluated. Only one document summary out of four total documents is also a concern.

Missing mandatory exclusion grounds
Missing financial requirements
Fairness60/100

The DPS structure allows for continuous application, promoting fair access over time. The requirements for contractors appear generic and not tailored. However, the complete absence of specified evaluation criteria severely undermines transparency and fairness in the assessment process.

No evaluation criteria specified
Potential limited access to all tender documents (only one summary provided)
Practicality70/100

The tender indicates support for e-procurement and clearly specifies the contract duration and the commencement date for the additional categories. However, a direct URL for tender documents is not provided, and specific financing details beyond the estimated value are absent.

No direct document URL
No specific financing information beyond estimated value
Data Consistency85/100

Key dates, including the DPS term end and contract duration, are logical and consistent. Most essential fields are populated, contributing to good data integrity. A minor contradiction regarding e-submission was noted in automated checks but not in the tender's explicit characteristics.

"Liable Person" field is empty
Sustainability30/100

The tender does not explicitly incorporate any green procurement, social responsibility, or innovation-focused criteria. This represents a missed opportunity to align with modern sustainable procurement practices.

No explicit green procurement, social, or innovation criteria

Strengths

Concerns

Absence of explicit mandatory exclusion grounds and financial requirements
Lack of specified evaluation criteria for applications
Limited transparency regarding full tender document access
No integration of sustainability, social, or innovation aspects
Missing "Liable Person" information

1. Publish comprehensive evaluation criteria, mandatory exclusion grounds, and financial requirements.
2. Ensure all tender documents are easily accessible via a direct URL.
3. Integrate sustainability, social, and innovation considerations into future DPS categories.
