Originalus konkurso aprašymas

Homes England is seeking to establish a Dynamic Purchasing System (DPS) to replace the Delivery Partner Panel (DPP3) for housebuilders, contractors and residential developers to work with Homes England and other contracting authorities who may wish to develop homes on land that they own. The DPS aligns with Homes England's mission and objectives as set out in our Strategic Plan. The intention is for the DPS to run for 10 years and be split into categories for the delivery of small (up to and including 70 homes) and large (more than 70 homes) development sites. Our DPS (both categories) will cover all areas in England but suppliers will be asked to select at selection questionnaire stage which areas of the country they would be interested in receiving opportunity notifications for. These 9 regional subcategories are: - East Midlands - East of England - London - North East - North West - South East - South West - West Midlands - Yorkshire and The Humber DPS Suppliers will also be asked to select (for both categories) which Development Types they would be interested in receiving opportunity notifications for. These 5 subcategories are: - General residential led development - Sites including conversion, refurbishment and works to listed buildings - Sites to be delivered via a construction and direct contracting approach - Sites including Extra Care and other forms of supported living - Sites providing 100% Affordable Housing DPS Suppliers will be able to amend their subcategory preferences at any point as their business grows and develops. We plan to add additional categories over time and all DPS members will be invited to express interest in any additional categories. We will offer an initial opportunity to join the DPS, this will run from 24 May 2021 to 5pm on 25 June 2021. We will then evaluate responses and reopen the opportunity to apply from 1 September 2021. Calls for competition will be published from September 2021 onwards.

Konkurso kokybės įvertinimas

This tender establishes a Dynamic Purchasing System (DPS) with a substantial estimated value and broad scope across England, aiming to streamline housing development. However, the provided information lacks critical details regarding mandatory exclusion grounds, financial requirements, and actual tender documents, raising significant concerns about transparency and completeness.

Įvertinimo detalės

Atitiktis teisės aktams100/100

The tender description outlines a DPS, which is a legally recognized procurement tool. However, the explicit absence of mandatory exclusion grounds and specific financial requirements in the provided extract is a significant legal compliance concern, as these are fundamental aspects of public procurement regulations. The classification as 'Restricted procedure' for a DPS is also somewhat contradictory, as DPS are inherently open for new suppliers to join throughout their lifetime.

Absence of explicit mandatory exclusion grounds
Absence of explicit financial requirements
Aiškumas40/100

The description of the DPS structure, categories, and subcategories is generally clear and well-defined, allowing potential suppliers to understand the scope and how to express interest. The flexibility for suppliers to amend preferences over time is also clearly stated.

Užbaigtumas83/100

The provided information is severely incomplete. The lack of any attached documents, explicit mandatory exclusion grounds, and specific financial requirements for a €20 billion tender is a major deficiency. While the description details the DPS structure, the absence of core tender documentation means a full assessment of completeness is impossible.

No tender documents provided
Missing explicit mandatory exclusion grounds
Sąžiningumas80/100

The DPS structure, allowing continuous application and selection of specific regions and development types, generally promotes fairness and broad participation. The ability to amend preferences over time also supports evolving business capabilities. However, the lack of detailed financial requirements and evaluation criteria could introduce subjectivity if not properly defined in the full tender documents (which are missing). There is no indication of requirements being tailored for a specific company based on the provided text.

Potential for subjectivity due to missing evaluation criteria and financial requirements (if not detailed elsewhere)
Praktiškumas40/100

The DPS model itself is highly practical for long-term, multi-supplier frameworks, allowing flexibility for both the contracting authority and suppliers. The categorization by region and development type is practical for matching opportunities with supplier capabilities. The continuous application process is also practical for maintaining a dynamic pool of suppliers.

Duomenų nuoseklumas100/100

The information provided is largely consistent, with the 10-year contract duration aligning with the DPS description. The regional and development type subcategories are clearly listed. The only minor inconsistency is the classification of a DPS as a 'Restricted procedure', which is typically an open procedure for joining the system itself.

Minor inconsistency in classifying a Dynamic Purchasing System as 'Restricted procedure'
Tvarumas25/100

The provided information does not explicitly mention any sustainability criteria (environmental, social, or economic beyond the core housing delivery). This represents a missed opportunity for a tender of this scale and duration, especially given the nature of housing development.

Absence of explicit environmental sustainability criteria
Absence of explicit social sustainability criteria

Privalumai

Utilizes a Dynamic Purchasing System (DPS) for flexibility and continuous market access.
Clear categorization by region and development type, allowing tailored supplier engagement.
Significant estimated value and long duration indicate a strategic, long-term commitment.
Innovation Focus characteristic promotes modern development approaches.
Flexibility for suppliers to amend subcategory preferences over time.

Problemos

Critical absence of any attached tender documents, making a full assessment impossible.
Lack of explicit mandatory exclusion grounds, a fundamental requirement for public procurement.
Absence of specific financial requirements for a €20 billion tender.
Missing explicit evaluation criteria for the selection questionnaire.
No mention of environmental or social sustainability criteria for a major housing initiative.

Rekomendacijos

1. Immediately publish comprehensive tender documents, including full terms, conditions, and detailed evaluation criteria.
2. Clearly define and publish all mandatory exclusion grounds and specific financial requirements.
3. Integrate explicit environmental and social sustainability criteria into the tender and subsequent calls for competition.
