Originalus konkurso aprašymas

Derbyshire County Council ("the Council") organises and funds transport for a wide range of passengers travelling from/to and within Derbyshire. Actual delivery of the service is undertaken by a broad range of operators, from sole-trader taxi operators through to minibus, coach and bus operators who bid for the work as and when tender opportunities become available throughout the year. This is the new and improved Dynamic Purchasing System (“DPS”) for the provision of passenger transport services on behalf of the Council. This DPS replaces the current three DPS’s in place (STDPS001, ETC7596 & ETE7655) and although applications can be submitted immediately, it is anticipated that mini-competitions will commence in April 2023, at which point the current three DPS’s will be terminated. Applications to join can be submitted at any time throughout the duration of the DPS. Terms and Schedules can be accessed and applications can be submitted at this link, having expressed an interest in the opportunity >> https://procontract.due-north.com/Advert?advertId=8384140e-6c71-ed11-811c-005056b64545&p=527b4bbd-5c58-e511-80ef-000c29c9ba21 This DPS is an agreement that sets out the terms under which individual contracts (call-offs) are made throughout the period the DPS is in place for. A DPS is used where the Contracting Authority know they are likely to have a need for passenger transport services but are unsure of the extent or schedule. Initially the DPS will be in place for 10 years with the option to extend this timeframe. The DPS operates entirely electronically, therefore it is the operator’s responsibility to ensure at all times they have access to the Councils’ E-Tendering Portal and that their profile is kept up to date. This DPS shall provide transport commissioned by the Council to meet all eligible passenger’s needs, its statutory duties and strategic planning for transport services. In order to meet these needs, there are 5 lots available based on vehicle size. Operators who have joined the DPS will have demonstrated though successful completion of the Councils Selection Questionnaire that they can deliver the service and agreed to pre-determined terms and conditions and schedules. Call offs or individual contracts will be awarded on the basis of mini-competitions (also known as invitation to tender) which will be held between all the operators on the DPS.

Konkurso kokybės įvertinimas

This tender establishes a Dynamic Purchasing System (DPS) for passenger transport services, offering flexibility and continuous market access over a long duration. However, the critical absence of core tender documents significantly hinders a comprehensive quality assessment.

Įvertinimo detalės

Atitiktis teisės aktams100/100

The use of a Dynamic Purchasing System (DPS) is a legally compliant procurement tool, promoting continuous market access. However, the classification as 'Restricted procedure' is inconsistent with the nature of a DPS, which is a flexible framework, not a traditional restricted procedure. The description mentions mandatory exclusion grounds and financial requirements are typically in the Selection Questionnaire, but these are not provided for review.

Inconsistency between 'Restricted procedure' classification and the description of a Dynamic Purchasing System (DPS).
Lack of explicit detail on mandatory exclusion grounds and financial requirements within the provided tender description, relying on an unprovided Selection Questionnaire.
Aiškumas40/100

The description clearly explains the purpose and operational model of the DPS, including its electronic nature and the continuous application process. The mention of 5 lots based on vehicle size adds clarity regarding service segmentation.

Užbaigtumas83/100

This is a major concern. The tender information provided is a high-level description, with a critical absence of actual tender documents (Terms, Schedules, Selection Questionnaire). Without these, essential details such as full eligibility criteria, detailed technical and financial requirements, and crucially, the evaluation criteria for mini-competitions, are missing.

Absence of core tender documents (Terms, Schedules, Selection Questionnaire).
Missing detailed eligibility, technical, and financial requirements.
Sąžiningumas80/100

The DPS model inherently promotes fairness by allowing new operators to join at any time throughout its duration, fostering competition. The segmentation into 5 vehicle size lots also suggests an effort to accommodate a diverse range of operators. However, without the actual Selection Questionnaire and mini-competition evaluation criteria, a full assessment of fairness is limited.

Inability to fully assess fairness without access to the Selection Questionnaire and detailed evaluation criteria for mini-competitions.
Praktiškumas40/100

The electronic operation and continuous application process of the DPS are highly practical for both the contracting authority and potential operators. The long duration (10 years with extension option) provides stability and long-term planning benefits. The use of mini-competitions for call-offs allows for flexible and specific service commissioning.

Duomenų nuoseklumas100/100

The primary inconsistency lies in the classification of the tender as 'Restricted procedure' while describing a Dynamic Purchasing System. Otherwise, the estimated value and duration appear consistent with a large-scale, long-term transport framework.

Inconsistency between the 'Restricted procedure' classification and the detailed description of a Dynamic Purchasing System (DPS).
Tvarumas0/100

The provided tender description makes no explicit mention of sustainability, environmental, social, or innovation criteria. For a high-value, long-term contract of this nature, this represents a missed opportunity to integrate broader public value objectives.

Absence of explicit sustainability, social, or innovation criteria.

Privalumai

Utilizes a Dynamic Purchasing System (DPS) for flexibility and continuous market access.
Long contract duration (10 years with extension option) provides market stability.
Clear explanation of the DPS operational model and electronic application process.
Segmentation into 5 lots based on vehicle size caters to diverse operator capabilities.
High estimated value indicates significant opportunity for the market.

Problemos

Critical absence of core tender documents (Terms, Schedules, Selection Questionnaire) for detailed review.
Inconsistency in procedure classification ('Restricted procedure' vs. DPS).
Lack of explicit detail on mandatory exclusion grounds, financial requirements, and mini-competition evaluation criteria in the provided text.
No integration or mention of sustainability, social, or innovation criteria.
Potential for lack of transparency in mini-competition evaluation if not clearly defined in unprovided documents.

Rekomendacijos

1. Ensure all core tender documents, including Terms, Schedules, Selection Questionnaire, and detailed evaluation criteria for mini-competitions, are fully accessible and clearly linked.
2. Correctly classify the procurement procedure to accurately reflect a Dynamic Purchasing System, rather than 'Restricted procedure'.
3. Integrate and clearly communicate sustainability, social, and innovation criteria within the DPS framework and subsequent mini-competitions.
